On 26 February 2013, the Maryland Senate passed legislation preventing the expansion of electronic gambling in the state. Senate Bill 272 was cosponsored by half of the Senate's budget panel and was drafted as a direct response to the Maryland State Lottery & Gaming Control Agency's plan to sell lottery tickets online. The bill has been assigned to the Ways and Means Committee in the House of Delegates. The committee has not voted on the matter.

Daily fantasy sports were legalized in 2012, but Attorney General Brian Fosh questioned the ability to legalize it without a change to the states constitution. The general assembly has not attempted to clear up this ambiguity. Senate Bill 0976 which spells out more rules for industry is making its way through the legislature with a contingency to pass through a referendum.

In January 2017, Marylan's Comptroller implemented additional regulations to oversee the daily fantasy sports industry. These regulations had been officially announced in July 2016.
